General Terms and Conditions of Service

1. Introduction and Scope of these GTC

1.1 Tamelys.com is an online platform operated by GCT AGENCY S.A.R.L., a company registered in Luxembourg under number B306520, with its registered office at 11, Rue des Trois Cantons, L - 8399 Windhof (Koerich), Luxembourg (hereinafter "we", "our" or "Tamelys"). 1.2 These General Terms of Service (GTS) govern your access and use of Tamelys.com, as well as any order placed via the platform, whether for the purchase of items or the "VIP member" subscription.

1.3 You can keep these GTS in electronic or printed form. The current version is always available on the Tamelys.com website, and a copy will also be sent to you by email after each order.

2. Terms of Use for Tamelys.com

2.1 Access to Tamelys.com and the ability to purchase items require the creation of a user account. You can create a free account or subscribe to the "VIP Member" subscription to benefit from exclusive advantages.

2.2 Tamelys.com is exclusively intended for end consumers. You are considered a consumer if you use the platform for personal and non-professional purposes.

2.3 The applicable contractual language is French.

3. Creating a User Account

3.1 To create an account, you must provide accurate and complete information during the registration form.

3.2 Registration is reserved for adults or minors under the responsibility of their legal representative.

3.3 The activation of your account confirms the acceptance of these GTS and constitutes the formation of a contract between you and Tamelys.

3.4 We reserve the right to delete any account created abusively or multiply.

4. Standard Account and Features

4.1 The standard account allows you to browse and purchase items available on Tamelys.com. Certain items or promotions are exclusively reserved for VIP members.

4.2 Each month, we highlight new items adapted to your preferences.

4.3 It is recommended to keep your personal information up to date to ensure the proper functioning of your account.

4.4 The standard account can be closed at any time by the user without prior notice. We reserve a four-week notice period in case of account deletion by Tamelys.

5. "VIP Member" Subscription

5.1 The VIP subscription is a paid option at €39.99/month that allows you to access exclusive offers, discounts, or items reserved for VIP members.

5.2 Advantages include:

  • A 5-day free trial period to try "VIP Member" discounts before the subscription is charged.

  • Priority access to new items

  • Preferential rates or additional discounts

5.3 Monthly VIP subscription fees are automatically debited, unless you choose to cancel the subscription. Payments can be used as VIP Credit for your future purchases.

5.4 The "cancel subscription" function allows you to suspend your subscription to avoid automatic debiting of fees. You can reactivate your benefits at any time from your customer account.

5.5 The VIP subscription is for an indefinite period and can be terminated at any time. Termination will take effect immediately. You can terminate via your online account or by contacting customer service.

6. VIP Credits

6.1 VIP Credits are internal credits that can be used to purchase items on Tamelys.com. They have no monetary value outside the platform.

6.2 In case of a refund for a purchase made with Credits, the refund is made in the form of Credits. Purchases paid directly are refunded via the original payment method, unless otherwise requested.

6.3 Credits are neither transferable nor exchangeable for cash.

6.4 Credits expire two years after their allocation.

7. Prices and Service Fees

7.1 Prices indicated include legal taxes and may vary depending on standard or VIP subscriber status.

7.2 Shipping costs may be added, unless otherwise specified.

7.3 Price changes related to cost or tax variations may be applied once per calendar year. You will be informed in advance by email.

7.4 You have the right to cancel your VIP subscription if a price change is unfavorable to you.

8. Liability

8.1 Tamelys is responsible for damages resulting from its intentional or serious fault, as well as for bodily harm or health damage.

8.2 For other cases, our liability is limited to direct and essential damages related to the performance of the contract.

9. Intellectual Property

9.1 All content, logos, images, and texts on Tamelys.com remain our exclusive property. Any reproduction or use without written authorization is prohibited.

10. Modifications to the GTS

10.1 We reserve the right to modify these GTS, provided that the modifications are reasonable and justified.

10.2 You will be informed of changes by email and have six weeks to contest them. After this period, they are considered accepted.

11. Applicable Law and Dispute Resolution

11.1 Contractual relations are governed by Luxembourger law.

11.2 Online Dispute Resolution: In accordance with Regulation (EU) No 524/2013, the European Commission has set up an Online Dispute Resolution (ODR) platform to facilitate independent, out-of-court resolution of online disputes between consumers and professionals in the European Union. 11.3 If a provision is deemed invalid, it will be replaced by the applicable legal provision, without affecting the remainder of the GTS.

12. Model Withdrawal Form
